Bull. Its just one of those things. What next? Suing someone for having

Much depends on the judge, the jury, and the defense attorney(s).

If on the jury, I would have to be convinced that the facility's ower
was aware of the practice and approved its continuance before I could
assess blame there. It can be expected that random people, including
employees, will do foolish things that seem harmless (feeding
squirrels being one very common example) in public places; this does
not mean that the owner of the public place should be culpable for the
results of this common behavior if they had no hand in permitting or
encouraging it.

OTOH, if they had a vending machine by the door selling handfuls of
Purina Squirrel Chow for 50 cents a pop, it would be really hard to
defend against the claim...and that's a good bit of the reason why you
don't see people selling sacks of breadcrumbs to feed the birds in
parks and other public areas.

LOL! I'm only 4+ miles from this mall, which is quite upscale. I got a
lovely mental image of the squirrel feed machines. I'm thinking next to
Nordstrom's would be a good spot.

Actually I have seen convenience stores next to a park teeming with
squirrels that sells raw peanuts. Queens Park Toronto when I lived their in
the 90's. Locally there are hotdog cart vendors who simply dump their unsold
buns at the end of the day for sparrows, gulls and such.

I'm one to rail against frivolous lawsuits and I wouldn't award her a cent
in this one either but I would point out two things:

[1] The property owner need not instigate actions of the employees to be
found liable. The owner can be found responsible for the actions of
employees in some cases.

[2] Let's change the setting to Florida and the animal to an alligator. Now
would you think the employees who encouraged an alligator to come on the
property from the sh next door associate food with people by feeding it
should bear some responsibility if someone is attacked by the critter on the
commercial property? Or shift it to a plaza in Alberta and the animal to a
grizzly bear. Someone who causes the bear to associate food with people has
some culpability if the next person gets attacked, ethically if not legally
and I expect legally as well.

But a squirrel is not an alligator nor a bear.

She's suing for AT LEAST $50k, which means her lawyer is fishing for all
they can get.

I believe there's a legal concept in some areas called the 'One Bite'
rule where an animal is given a chance to show it's 'vicious' before it
has to be considered 'known-by-all' to be dangerous.

BTW, did you notice the shop she was coming out of, and the area?

Given the shop and the area, I wonder if "My boy is a big-time lawyer,
and better than your son the dentist, any day."

Or, someone had a lawyer on retainer and wanted to make them earn their
fee, or someone was up late at night and saw one of those 'Loser-O'Clock-
