hit by r turn car in cross walk got ticket help Boulder Colorado Folsom and Arapahoe In cross walk coming down from CU In cross walk at second white strip almost go by the car turning right he hit my rear basket knocking the bike 2 feet broke out his left turn signal lights broke a few spokes had to buy a new rim for $45 Got a ticket for going wrong direction as traffic on my side was going east I was going west got a picture of students doing same... as 1k students a day bike through this cross walk.... same as I did . If it is legal to ride on the sidewalk, then you can do it either direction. If riding on the sidewalk is prohibited there, which I believe it is, then you were riding illegally; however, that is not the ticket you received, so you may be able to bust out on a technicality. I think a lot of those students you saw were high school kids, do not model their behavior. Jalino's Pizza still there? Fond memories of that place. Robert

The CU student had a suspended lic... no valid lic.. no insurance no registration so under the law he was legally not suppose to be on the road driving... so would a lawyer argue in court my ticket should be voided? ps Only lawyers should reply. I was hit by a car making a right turn, he had tinted windows so could not see him. This is a major intersection as 1k to 5k students use it every school day the exact same way I crossed through the intersecion on their bikes... so drivers know its one of the top 3 or 4 intersection students cross with their bikes and walking. The intersection is Folsom and Arapahoe in Boulder Colorado. I made it to the second white stripe and almost to the non right turn lane when he hit my bike basket knocking my bike a foot or two. So I should of been in his vision. He could of been on a cell phone I could not see in his windows. Well, I'm not a lawyer, but by putting your message on this newsgroup you did send your message to me. Tell us more about this ticket. It must carry one hell of a penalty if you figure it's worth paying a lawyer's fees for the somewhat uncertain chance of beating it If you are worried about having irritated some mysterious driver, in a car with tinted windows, who you seem to think is above the law, maybe a lawyer is not what you need for protection. Further, what about someone from say, Coal Creek, CO who has never been to Boulder before and knows nothing of the 1-5K of students that "cross with their bikes and walking?" You got a ticket becasue you were somehow in the wrong. Riding a bike in the roadway, even while on a crosswalk, makes puts you in the same classification as a car and you have to follow car rules. Apparently, you were coming towards him which is basically equivalent to a car driving down the wrong side of the road. It doesn't matter if a million cyclists a day do the same thing.

If you're not comfortable with that, this isn't the place for you. If you only want to hear from lawyers, why are you posting in a cycling newsgroup? While there might be people here who happen to be lawyers and one or two might even be licensed to practice in your neck of the woods, I'd be very surprised if any such people felt like giving you free legal advice. If you're determined to fight the ticket and don't have the know-how to do it on your own, you need to talk to a local lawyer who deals with traffic cases rather than asking for help on the Internet. Make sure you have your checkbook ready.

My sentiments exactly - OP should learn how to clearly express the facts - I could hardly understand what he is describing. To OP: you were riding on the sidewalk, using the crosswalk, yes? If so, did you have the "Walk" signal? If you did, you might be able to beat it, depending on local laws. For instance, local laws MIGHT say that if you're biking through a cross walk, you have to walk the bike. The laws in my state say that you cannot bicycle on sidewalks in a "business district" whatever that means. It surely applies to busy urban areas. But, I simply don't know. If you didn't have the walk signal, and have a witness to that effect, my guess is that you're totally out of luck, and should be. Finally, only idiots ride on sidewalks/crosswalks - IMHO of course. But you should ride on the road.

The damage to the bike is unfortunate, but not a big deal compared to any injury. My advice: You were in the wrong. Take your lumps and learn from it. Riding on the sidewalk, especially facing traffic, is an excellent way to get hit by a car. You're still interacting with traffic, but you're outside the normal line of sight and moving much faster than walking speed in a space where drivers generally only look far enough ahead to spot pedestrians. The key to road safety is to play by the same rules as everyone else, to be visible, and to be predictable. Riding on the sidewalk, epecially facing traffic, fails on all three points. I'm sorry you were in an accident and I know this isn't what you want to hear, but right now you should focus on learning to avoid such things in the future rather than getting out of a ticket that you probably deserved.
