Smart ones do. Settle doesn't mean anything other than coming to an arrangement that both can live with. Please note that neither party will be 100% happy with the arrangement. That is a good thing. Frequently this involves gag orders and the like, since people don't want other people to know how much they had to give up to make the thing go away. That way both sides can claim victory. The alternative is to do what you do - get on your high horse and make chest-thumping sounds on Usenet about matters that don't involve you. Whatever floats your boat. R

But he's free to talk about what I would like to see in the book. It usually costs more to defend and win than it does to settle. A tiny percent percent of those cases ever go to trial. It's something like 2 or 3 percent. Does that mean that 97-98% of defendants were in the wrong? Back in the day my father (sports editor for a local newspaper, back when that meant something) covered a bike race in San Jose, held at the county fairgrounds. The guaranteed prize list was quite large, but what materialized was maybe 20% of that, if that. Total scam. The promoters failed on a number of other counts as well; this was not too different from a "Music Man" sort of thing. A lot of people put a lot of volunteer work into it, and my father wrote about it. It was actually a pretty tame piece, all things considered. And, of course, the promoters threatened to sue. No question that the newspaper would have won the case, but it would have been expensive and time-consuming to do so, so they settled.
