The United States Anti-Doping Agency (USADA) denies delaying matters.
"We're ready to proceed," USADA general counsel Travis Tygart said. "We
want hearings as soon as possible."

Landis' spokesman Michael Henson said that the main reason for the delay
is the difficulty in getting the USADA to turn over documents requested
by Landis' legal staff. "It's a real uphill battle for them to get the
basic pieces of information they need to conduct a fair hearing," Henson
said.

Landis is getting duped by his defense team for billable hours. If
Jacobs wants those documents why doesn't he just file a motion with the
CAS?

Jacobs keeps asking USADA because it runs up the billable hours he can
claim, knowing full well USADA will say no. This is the kind of
nonsense that goes on in law firms. I've seen some of these requests he
makes to USADA. Each request must cost Landis a good $5,000 to $10,000
in legal fees. It's ridiculous and unnecessary.

Jacobs knows that all these requests he's making are not allowed under
WADA rules (rules which Landis and the UCI agreed to abide), so he
doesn't want to file a motion to the arbitration Panel, who will likely
deny it.

Why are you discrediting Magilla instead of following the thread? Do
you have feelings of inferiority? Delaying could also be a tactic for
the defense.

It's a fact. You don't need a law degree to understand basic facts of
the arbitration process works.

Landis's attorney is free to file amotion with the CAS to request any
documents they want. USADA doesn't control the discovery process. It's
just like a real court of law where any dispute in discovery should be
resolved by the court.

Landis's attorney just doesn't want to file that motion with the CAS
Panel because it will be denied, and then Landis's team will no longer
be able to tell the media USADA is treating them unfairly.
